内容	：	(1) In this lecture, we will first briefly review 2012’s Mayo v. Prometheus case and USPTO Guidelines, followed by a discussion of a recent CAFC case applying this law.  Then, we will discuss this year’s Myriad decision and discuss claim strategies in view of this decision. （抄訳）本講義では、先ず、２０１２年のMayo v. Prometheus事件と米国特許商標庁のガイドラインを検討し、その後、本規範を適用した近時のCAFCの事件について議論します。そそてい、本年（２０１３年）のMyriad判決を検討し、当該判決を踏まえた、クレーム戦略について検討します。 (2) In this lecture, we will discuss a variety of recent topics covered by the CAFC, including claim construction of “essentially free of” (Sunovion v. Teva), patent exhaustion where product is given away for free (LifeScan v. Shasta), claim construction of a functional feature later proved incorrect (Bayer Cropscience v. Dow Agrosciences) and whether conception and reduction to practice can be present where DNA sequencing includes errors (Sanofi-Aventis v. Pfizer). （抄訳）本講義では、CAFCによってカバーされた幾つかの近時のTOPICについて議論します。本講義では、具体的には、「本質的に・・・を含まない」との文言のクレーム解釈についてのSunovion v. Teva事件、製品が無償提供された場合の消尽論についてのLifeScan v. Shasta、後に正しくないことが証明された機能的特徴のクレーム解釈についてのBayer Cropscience v. Dow Agrosciences事件、および、DNA配列がエラーを含む場合の着想と具体化の存否についてのSanofi-Aventis v. Pfizer事件を含みます。
